Entire Agreement. This agreement contains the entire understanding between the COMPANY and The CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.  

Retainer and Payments. Both a $500.00 retainer and signed contract holds your date and time and is non-refundable should you no longer require my services. No amount of monies paid to me are refundable unless I experience an emergency that renders me unable to provide the agreed services. The balance of the contract is due fourteen (14) days before the event date. The proposed contract will expire five business days from preparation date if both the non-refundable retainer and signed contract are not received from the CLIENT by the COMPANY.   

Payment ScheduleThe aforementioned $500.00 non-refundable retainer fee is due at the time of signing of agreement. The remaining balance is payable in full 14 days prior the EVENT(S). In the event the CLIENT fails to remit payment as specified, the COMPANY shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not attend the EVENT(S).  

Cancellation. Should you cancel this agreement, liquidated damages shall be charged in the amount of the $500.00 retainer, for The COMPANY declining other work. All work completed for the event will be billed at a la carte pricing plus tax. Any and all cancellations must be received in writing via registered mail from the CLIENT for the event to be considered cancelled.   

Returned checks. Any check returned for non-payment will be assessed a $30.00 non-sufficient funds fee.   

Event Schedule. The client agrees to confirm the schedule one-week prior to the EVENT(S). Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from the COMPANY by the CLIENT.   

Safety. The COMPANY reserves the right to terminate coverage and leave the location of the EVENT(S) if the photographer from the COMPANY experiences inappropriate, threatening, hostile or offensive behavior from person(s) at the EVENT(S); or in the event that the safety of the photographer from the EVENT is in question.  

Venue and location limitations. The COMPANY is limited by the rules and guidelines of the location(s) and site management. The CLIENT agrees to accept the technical results of their imposition on the COMPANY. Negotiation with the officials for moderation of guidelines is the CLIENT’s responsibility; the COMPANY will offer technical recommendations only.  

Exclusive Photographer. The COMPANY shall be the exclusive photographer retained by the Client for the purpose of photographing the event. Videographers are not permitted to use still cameras to avoid unwanted confusion with MLP. Family and friends of the Client shall be permitted to photograph as long as they don’t interfere with Photographer's duties and do not photograph poses arranged by Photographer. The COMPANY can not be held liable for failing to capture images that are disrupted by your guests or other vendors, due to reasons such as, but not limited to, obstruction, other camera flashes, looking at other cameras.   

Failure to Perform. Should I have an emergency beyond the control of both parties and I am no longer able to provide my services, I will refund your retainer. This would only be in the case of a true emergency and is never expected to be a possibility. I will help you secure another professional photographer in such an event.   

Copyright and Reproductions

  • The COMPANY retains the right to copyright the photographs in her own name or in any other name that she may select.
  • If and when a print release is included in a purchased package the CLIENT may only print images up to stated size for personal use only. The COMPANY is not liable for the quality of prints from outside vendors. Only images printed through the COMPANY and her professional vendors will be guaranteed for quality of product.   
  • The COMPANY may use a service such as Pic-Time for delivery of digital images and proofs. See Terms of Service for Pic-Time.

Model Release:

  • Photographs taken by The COMPANY may be used for the purposes of portfolio, samples, entry in photographic contests, art exhibitions, display, advertising, website and any publication to promote her business. The COMPANY will never display images in a negative or unappealing light or use them for further financial gain {photos are not sold to photo stock agencies}.
  • The CLIENT waives any right to inspect or approve the representations for advertising, trade, or any other lawful purposes, and CLIENT waives any right to inspect or approve the finished version(s), including written copy that may be created and appear in connection therewith.   


Weather. The COMPANY can not be held responsible if the weather prohibits certain locations to be used on the day of the EVENT. Such weather may include, but is not limited to - rain, lightning, heavy winds and hail.  

Capture and Deliver. The COMPANY is not liable to deliver every image taken at the event. The determination of images delivered to the CLIENT is left to the discretion of the COMPANY. Images that do not meet the COMPANY'S high standards of quality will immediately be deleted and therefore are not able to be viewed even if requested. Such limitations might include, but not limited to: eyes closed, duplicate images and unflattering poses. The COMPANY does not guarantee a minimum number of images in the CLIENT'S final gallery due to the unique nature of each event.  

Album Design

  • The CLIENT will propose and advise in the layout of the CLIENT(S) album(s), however, all choices by the CLIENT prevail.
  • Two sets of design revisions are included with the fee. Any additional album design changes will be billed at $50.00 per requested change.
  • Due to the custom nature of album orders, all orders are final upon submission of the CLIENT'S final approval.
  • Final approval of the album design must be completed within twelve months of event date, , or CLIENT will forfeit their album.
  • Albums will be delivered 4 - 6 weeks after the final revisions have been approved by the CLIENT.
  • Where an album was not included in the Collection a 50% deposit is required with the final CLIENT design approval. The album order will only be placed once both the deposit and approval are received.
